Reinitiation of a licensing procedure under atomic energy law

Description
A valied licence under Paragraph 7 I of the Atomic Energy Act cannot be nullified by the reinitation of a licensing procedure. A decision on the merits is only feasible after a suspension of the licence. On the preconditions on which pursuant to Paragraph 17 V of the Atomic Energy Law third particles may enter a claim for the withdrawal of a licence to erect and operate a nuclear reactor (rejected here in the case of contended new knowledge on provisions for disposal, the risk of airplane crashes, low level radiation and on main as a 'factor of risk'). Eine bestandskraeftige Genehmigung nach Paragraph 7 I AtG kann nicht durch Wiedereintritt in das Genehmigungsverfahren beseitigt werden; eine neue Sachentscheidung kommt erst nach Aufhebung der Genehmigung in Betracht. Zu den Voraussetzungen, unter denen Dritte den Widerruf der Genehmigung zur Errichtung und zum Betrieb eines Kernkraftwerk Grafenrheinfeld gem. Paragraph 17 V AtG beanspruchen koennen (hier verneint fuer die Behauptung neuerer Erkenntnisse zur Entsorgungsvorsorge, zum Risiko von Flugzeugabstuerzen, zur Bewertung der Niedrigstrahlung und zum 'Risikofaktor Mensch').
