Problems arising in the implementation of EU regulations and harmonisation with established German nuclear law. Third party protection through directly applicable regulations

As the impact of EU legislation on the national law of Member States is increasing, the author discusses problems arising in Germany in connection with the implementation of EU regulations, as well as outline solutions, particularly with respect to third party protection offered by directly applicable EU regulations. He illustrates his point with the example of the EU regulation on environmental impact statements (EIS), in this context here with respect to public projects, which includes nuclear power plants and radwaste repositories. The author explains the legal consequences of the fact that Germany failed to integrate into its national legal regime the EIS regulation of the EU within the mandatory period of time and shows that, until complete harmonisation of the two regimes, third parties in Germany can obtain third party protection through directly applicable EU regulations.
