Description

Implementation of the Italian nuclear power programme requires that ENEL (the Italian State Electricity Agency) should solve a series of problems which are not only political, technical and financial, but also legal. The latter include the different positions held by constructors and operators in the nuclear law field. Although the operator must necessarily entrust construction work by contract to specialized agencies, the constructor as a person proper is completely ignored by the legislation in force, while the operator, as the holder of the construction licence is responsible with regard to all the provisions concerning controls, tests, inspections, etc. In recent years ENEL has frequently concluded ''turnkey'' contracts, but in future, given the desirability of diversifying the orders, ENEL may adopt a different policy, and negotiate different contracts with the suppliers of various components.
