The contradictions in nuclear trade law

Description

International law applicable to trade in nuclear materials, equipment and technology still lacks homogeneity and its implementation gives rise to some controversy. This is explained by the fact that this law, whose pivot is the Treaty on the Non-Proliferation of Nuclear Weapons, reflects several contradictions: the need to restrict communication of sensitive information and the will to encourage international cooperation in the peaceful uses of nuclear energy; acknowledgement of the differences in the status of the countries concerned and the principle of non-discrimination established by the Treaty; a selective policy for imports and the aim to achieve free access to nuclear technology. Abstract (French)

Le droit international applicable aux echanges de matieres, equipements et technologies nucleaires manque encore d'homogeneite et son application suscite diverses controverses. Cela s'explique par le fait que ce droit dont la piece centrale est le Traite sur la non-proliferation des armes nucleaires, reflete plusieurs niveaux de contradictions: entre le besoin de restreindre la communication des informations sensibles et la volonte de promouvoir la cooperation internationale dans le domaine de l'utilisation pacifique de l'energie nucleaire; entre la reconnaissance des differences de statut des pays concernes et le principe de non-discrimination etabli par ce Traite; entre une politique de selectivite des importations et l'objectif de libre acces a la technologie nucleaire
