'Practical sense' in the Atomic Energy Law

Description
The category system underlying risk assessment of power plants for the purpose of nuclear installation licensing is examined by the author as to whether it provides sufficient criteria for the management's complexity of large-scale technology projects. The role of the law must not end up only in the normative sanctioning of scientific know-how, but also has to deal with the social evaluation of risks and has to represent the medium of the social information through appropriate procedure. The modern 'practical sense' has to cope with the prospect view on an uncertain future and therefore looks for flexibility in the freedom of action. (HSCH)
Abstract (German)
Das dem atomrechtlichen Genehmigungsverfahren zugrundeliegende Kategoriensystem zur Abschaetzung der Risiken von Kernkraftwerken wird befragt, ob es genuegend Wahrnehmungskriterien fuer die Komplexitaet des Managements grosstechnologischer Projekte bereithaelt. Die Rolle des Rechts darf sich nicht erschoepfen in der normativen Sanktionierung naturwissenschaftlichen Sachverstandes, sondern muss die gesellschaftliche Bewertung von Risiken umfassen sowie ein Medium der gesellschaftlichen Selbstaufklaerung durch Verfahren darstellen. Die 'praktische Vernunft' moderner Lesart hat es mit dem prospektiven Vorgriff auf eine ungewisse Zukunft zu tun und sucht deshalb statt Sicherheit in der Wissenschaft Flexibilitaet von Handlungsoptionen.
