On the extent of control by administrative courts

Description
The growing extent of control by administrative courts entails a shifting of power from the executive to the courts. In the opinion of the author the control cannot be reduced by a general procedural clause. A limitation of control can only be achieved by modification of substantive law, similar to the provisions in sec. 7 para. 2 of the Atomic Energy Act. (WG)
Abstract (German)
Die Zunahme der verwaltungsgerichtlichen Kontrolldichte bewirke eine Machtverschiebung von der Exekutive zur Judikative. Nach Auffassung des Verfassers koenne die Kontrolldichte jedoch nicht durch eine prozessuale Generalklausel reduziert werden. Eine Begrenzung sei eher durch materiell-rechtliche Aenderungen zu erreichen, aehnlich wie in der gesetzlichen Regelung des Para. 7 II AtG. (WG)Additional details
