Legal aspects of a 'backing-out of nuclear energy'

Description
The author investigates the question, whether a backing out of nuclear energy, i.e. the prevention of the erection and commissioning of new nuclear power plants as well as the decommissioning of operating atomic power plants, is legally feasible. This depends on special provisions of the Atomic Energy Act, i.a. sec. 7 para. II, sec. 17 para. III, which have precedence of more general provisions. (WG)

Der Verfasser untersucht die Frage, ob ein Ausstieg aus der Kernenergie, d.h. die Verhinderung der Errichtung und Inbetriebnahme neuer Kernkraftwerke sowie die Stillegung bereits in Betrieb befindlicher Atomkraftwerke rechtlich durchfuehrbar ist. Massgeblich sind spezielle Vorschriften des Atomgesetzes, u.a. Para. 7II, 17III, die allgemeineren Rechtsnormen vorgehen. (WG)Additional details
