Wind turbine construction permit becoming environmental authorisation, lack of derogation for Protected Species and judge's office. Wind turbines and immaterial heritage: in search of lost time... for energy transition

A first article comments the introduction of a legal arrangement which transforms valid construction permits of wind turbines into environmental authorisations which comprise the derogation regarding protected species. The author reports how previous legal decisions finally resulted into this transformation: facts and procedure, legal decision about the legal nature of construction permits (opinion of a concerned company, decision of the State Council). He also describes how this decision takes place within a series of jurisprudence. Whereas an administrative court defined the notion of 'immaterial component' (artistic and cultural interest) to refuse the installation of wind turbines on a site described in the Proust's novel (In Search of Lost Time), a second article however notices that this decision is based on a too rigid analysis of the project impact
