Populations consultation requirements in the vicinity of dismantling sites

Description
The requirement of prior consultation of surrounding populations of nuclear sites in decommissioning is based on various instruments of environmental law - international, regional with the European Union law and national. The administrative High Court has already penalized the noncompliance in the specific context of nuclear decommissioning. If these environmental legal instruments don't require the form to be taken by the prior consultation of surrounding populations, the French nuclear law requires today the regulated procedure of public inquiry, but without requiring the organization of a prior public debate. L'obligation de consultation prealable des populations environnantes des sites nucleaires en demantelement repose sur divers instruments de droit de l'environnement - internationaux, regionaux avec le droit de l'Union europeenne et nationaux - dont le Conseil d'Etat a deja ete amene a sanctionner le non-respect dans le contexte precis du demantelement nucleaire. Si ces instruments juridiques environnementaux n'imposent nullement la forme que doit revetir la consultation prealable des populations environnantes, le droit nucleaire francais exige aujourd'hui la procedure reglementee de l'enquete publique, sans toutefois requerir l'organisation d'un debat public en amont.
