Apportioning liability for transborder damage

Description

The author analyses the different legal systems applicable to transfrontier nuclear damage. Using examples, he describes the mechanisms enabling a victim of such damage to identify the competent court and the relevant law, according to whether the provisions of the Paris or the Vienna Convention come into play or whether the rules of private international law, incorporated in the various national laws are applicable (NEA)

L'auteur analyse les differents regimes juridiques applicables aux dommages nucleaires transfrontieres. A travers certains exemples, il decrit les mecanismes permettant a la victime d'un tel dommage, d'identifier le tribunal competent et la loi applicable le cas echeant, selon les dispositions des Conventions de Paris et de Vienne ou selon les regles du droit international prive, incorporees dans les differentes legislations nationales
