Is a works council authorized to bring an action against a directive issued by the Atomic Energy Supervisory Authority?

The rights of the works council of a research centre in which nuclear facilities are operated cannot be violated by a directive issued by the Atomic Energy Supervisory Authority which requires that the security personnel (works protection force) be equipped with irritant vaporizers (gas pistols) and is therefore, according to Article 42 paragraph 2 Administrative Court Regulations, not authorized to contest the directive. Der Betriebsrat eines Forschungszentrums, in dem eine kerntechnische Anlage betrieben wird, kann durch eine von der Atomaufsichtsbehoerde erlassene Anordnung, den Objektsicherungsdienst (Werkschutz) mit Reizstoffspruehgeraeten (Gaspistolen) auszuruesten, nicht in seinen Rechten verletzt sein und ist deshalb gemaess Paragraph 42 Abs. 2 VwGO zur Anfechtung der Anordnung nicht befugt.
