Criminal offences considered in the Convention on the Physical Protection of Nuclear Material

Description

The Convention on the Physical Protection of Nuclear Material was signed in Vienna, on April 3, 1980, approved by Law 23.620 on September 28, 1998, and published in the Official Bulletin of the Argentine Republic on November 2, 1988. This Convention considers some aspects of Criminal Law and Criminal Procedural Law and integrates the normative hierarchical structure of the article 31 of the National Constitution. The adequacy of this Convention to the Argentine law is considered through two aspects: The first one examines figures existing in the Argentine Legislation about larceny and robbery of nuclear materials, misappropriation of nuclear materials, obtainment and fraud of nuclear materials, exaction through threat or intimidation, etc., which are considered in different articles of the Argentine Criminal Law. The second one analyses behaviours not foreseen in the Criminal Law and which are not qualified by the current Argentina's Criminal Code, such as exaction of nuclear material through the use of violence, the international perpetration of an act consisting to receive, possess, use, vacate, scatter nuclear material without legal authorization, or in the case that the act causes death, serious injuries to persons and others. The purpose of the future enactment of a new Nuclear Law is to put in order and fill-in gaps referred to different aspects such as civil liability in nuclear damages, characteristics of the nuclear damages, etc

Abstract (Spanish)

El Convenio sobre Proteccion fisica de los Materiales Nucleares y sus anexos, fue suscripto en Viena el 3 de abril de 1980, aprobado por ley 23.620 del 28 de setiembre de 1988 y publicado en Boletin Oficial de la Republica Argentina el 2 de noviembre de 1988. Dicha Convencion contempla aspectos del Derecho Penal y Procesal Penal e integra la estructura jerarquica normativa del articulo 31 de la Constitucion Nacional. Se plantea la adecuacion de la citada Convencion a la ley argentina a traves de dos aspectos: En el primero, a las figuras existentes en la legislacion argentina sobre hurto y robo de materiales nucleares, malversacion de materiales nucleares, obtencion y fraude de materiales nucleares, exaccion mediante amenazas o intimidacion, etc., que se tipifican en distintos articulos de la ley penal argentina. Y en segundo, conductas no previstas en la ley penal y que el Codigo Penal actual de la Republica Argentina no alcanza a calificar, como exaccion del material nuclear mediante uso de la violencia, la comision intencionada de un acto que consista en recibir, poseer, usar, evacuar, dispersar material nuclear sin autorizacion legal, o en caso de que el acto cause muerte, lesiones graves a personas y otros. Con la futura promulgacion de una nueva Ley Nuclear se propone ordenar y llenar vacios referidos a distintos aspectos como la responsabilidad civil por danos nucleares, las caracteristicas del dano nuclear, etc
