In the light of growing environmental consciousness, discussions in the general public on political and legal issues increasingly deal with the problem of the planning of projects having regional effects. Incidents and activities that could be observed as soon as the plans for extending the Frankfurt/Main and Muenchen-Erding airports were laid open show that the realisation of large governmental projects subject to plan approval have an impact not only on the region concerned, but also on society at large. The book in hand summarizes and critically reviews the court decisions and legal literature dealing with the plan approval procedure as an act terminating the procedure of sector planning; the provisions explained are then discussed with a view to the system of legal requirements to be met by sector planning law, and the legal regime providing legal redress. The book comprehensively discusses all the main problems involved, namely the official approval of the plan, its effects, the laws to be observed and the substantial decisions taken, as well as possibilities of legal redress in connection with the regional effects of the plan. Abstract (German)
Die politische und juristische Diskussion befasst sich heute - angesichts des sich stetig steigernden Umweltbewusstseins - immer mehr mit der Planung von raumbedeutsamen Vorhaben. Insbesondere die Vorfaelle um die Errichtung der Flughaefen Frankfurt-West und Muenchen-Erding haben gezeigt, welche ueber das politische Tagesgeschehen hinausgehende, gesamtgesellschaftliche Bedeutung mittlerweile der Realisierung von planfeststellungsbeduerftigen Vorhaben zukommt. Die Arbeit versucht, die Rechtsprechung und Literatur zum PlfB (Planfeststellungsbeschluss) als verfahrensbeendendem Akt der Fachplanung kritisch zu durchleuchten und in das System der rechtsstaatlichen Anforderungen an das Fachplanungsrecht und die Systematik des Verwaltungsrechtsschutzes einzuordnen. Gegenstand der Untersuchung ist somit der PlfB, seine Wirkungen, das bei seinem Erlass zu beachtende Recht und seine inhaltlichen Festsetzungen sowie - darauf aufbauend - der Rechtsschutz im Zusammenhang mit dem Erlass des PlfB.
