Law on renewable energies. January 2018 - December 2018

The authors propose a commented synthesis and overview of the evolutions of French laws and regulations related to renewable energies in 2018. They address wind energy: decree on offshore wind energies, discussion of the technical and financial capacities of the judge, disappearance of building permits and of modification permits, creation of specific contentious rules, action of third parties against wind energy permits, issue of landscape and of historical heritage, limited competence of the judge to order wind turbine demolition, problems raised by wind turbines regarding the army and aeronautical constraints, construction of a wind farm in an N zone, force of 'res judicata', validation of the additional remuneration wind energy regime. Then, they address solar energy: new plans as a missed occasion to develop collective self-consumption, European directive to promote self-consumption, scope of application of the moratorium decree, jurisprudence regarding the protection of consumers in terms of credit assigned to purchase to a solar plant, analysis of the compatibility of a ground-based solar plant with farming, absence of interest to act for agricultural professional organisations against the construction of a ground-based solar plant, taxing of the installation of solar arrays. The next part addresses biogas: wastes to accelerate the development of methanization, jurisprudence aspects, installation nomenclature modification, the right of injection of biomethane, jurisprudence about building permits for methanization units, European regulation on fertilisers, modification of the regulatory arrangement for nitrogen control, and so on. The next part addresses hydroelectricity: development of small projects, modification of administrative aspects, evolution of the concession legal framework. The last part addresses geothermal energy, and more particularly objectives of simplification of the legal regime
