Description

Canadian law in the field of transportation of radioactive materials has largely adopted international standards. Most of the respective laws, however, are as yet untested in court. According to the author it is likely that a broad and liberal interpretation will be given to all of the provisions which entitle injured parties to seek recourse against a transporter who has negligently carried out the duties imposed upon him. Das kanadische Recht hat im Bereich des Transports von Kernmaterial internationale Standards weitgehend uebernommen. Jedoch ist die Gesetzgebung bis heute groesstenteils noch nicht vor Gericht angewendet worden. Nach Meinung des Autors wuerden alle Vorschriften, die verletzten Parteien Rechte einraeumen, eine weite und liberale Interpretation erfahren, wenn die Partei Ansprueche gegen einen Transporteur, der die ihm auferlegten Pflichten nachlaessig ausgefuehrt hatte, geltend macht.
