The impact of the fundamental right to life and physical integrity on the interpretation of rules of procedure relating to atomic energy laws
Description
The author comments on the decision of December 20, 1979 by the Federal Constitutional Court on the Muehlheim-Kaerlich reactor. The decision was also published in NZW 1980, 760. The essence of the decision is to be found in the representation of effects this fundamental right may have on administrative proceedings relating to atomic energy laws. Up to now, the guarantee concerning effective legal protection and the applications and interpretations of rules of procedure in conformity with this fundamental right has been restricted to legal proceedings. The Federal Constitutional Court draws conclusions from fundamental rights which concern the interpretation and application of regulations on the organization of administrative proceedings. (HSCH)
Abstract (German)
Der Verfasser kommentiert einen Beschluss des Bundesverfassungsgerichts vom 20. 12. 79 zum Kernkraftwerk Muelheim-Kaerlich, der auch in N7W 1980, 760 abgedruckt ist. Wesentlich in der Entscheidung seien die Ausfuehrungen, ob und welche Auswirkungen sich aus dem Grundrecht auf das atomrechtliche Verwaltungsverfahren ergaeben. Bisher seien die Garantie effektiven Rechtschutzes und grundrechtskonforme Anwendung und Auslegung von Verfahrensvorschriften auf das gerichtliche Verfahren beschraenkt gewesen. Das BVerfG leite jetzt aus den Grundrechten auch Folgerungen fuer die Auslegung und Anwendung von Vorschriften ueber die Gestaltung des Verwaltungsverfahren ab. (HSCH)Additional details
