Study on nuclear nonproliferation conditions required by the US Atomic Energy Act in connection with nuclear cooperation agreements with the US

Description
In principle, the US Government is required to contain seven nuclear nonproliferation conditions into peaceful nuclear cooperation agreement (123 agreement) with other countries, in accordance with Article 123 of the US Atomic Energy Act. Such conditions originated from the US nuclear Nonproliferation Act (NNPA) of 1978. For about 40 years since the NNPA's enactment, such conditions, especially a condition which relates to other state's uranium enrichment and reprocessing activities have been varied, with change of international environment of nuclear nonproliferation and peaceful nuclear energy use and an increase of other states which conclude 123 agreements with the US. It is not clear current Trump administration's policy towards the agreement, but it seems that the administration will adopt the same policy as former George W. Bush and Obama administrations. 米国が他国と民生用原子力協力を行うためには、原則として米国原子力法(AEA)第123条が規定する9つの核不拡散要件を盛り込んだ原子力協力協定を締結する必要がある。この9つの要件は、1974年のインド核実験や世界的な核拡散の動きを受けて制定された1978年核不拡散法(NNPA)によりAEAに盛り込まれたものである。NNPAの制定から約40年を経て、9つの要件のうち、特に協定相手国内でのウラン濃縮や再処理の実施の規制内容は、核不拡散と原子力平和利用に係る国際情勢の変化や、協定相手国の増加に伴い、非核兵器国及び核兵器保有国の別、またその中でも協定相手国毎に多様化している。トランプ政権の核不拡散及び原子力協力協定等に係る考え方は必ずしも明確ではないが、現時点では、基本的には前ブッシュ(子)及びオバマ大統領と同様、多様性を持つフレキシブルなアプローチをとることが考察される。(著者)Additional details
