Description
A referendum in Sweden in 1980 regarding the future use of nuclear energy resulted in a Parliamentary decision not to build reactors beyond the twelve units already licensed and to decommission them all by the year 2010. The author analyses this decision and the 1980 Act implementing it, pointing out that during preparation of the latter, the Government stated that some compensation would be granted for a forced premature decommissioning, although the Act is silent in this respect. He discusses the legal basis on which a nuclear operator could base a claim and concludes that any compensation will finally depend on a decision by Parliament. (NEA)
Abstract (French)
A la suite d'un referendum en Suede, en 1980, concernant l'utilisation future de l'energie nucleaire, le Parlement a decide de ne pas construire de reacteurs au-dela des douze unites deja autorisees et de les declasser toutes d'ici l'an 2010. L'auteur analyse cette decision et sa loi d'application. Bien que cette loi ne le mentionne pas, il fait remarquer que le Gouvernment avait declare lors de son elaboration qu'une forme d'indemnisation serait accordee afin de pallier a un declassement force et premature. Il s'interroge sur les bases legales permettant a un exploitant nucleaire de porter plainte et conclut que toute indemnisation dependra finalement d'une decision du ParlementAdditional details
