Regulatory, administrative and financial problems raised by radioactive waste disposal

Description
This paper analyses the salient aspects of the non-technical problems involved in radioactive waste disposal: the division of operational, regulatory and administrative responsibilities, the usefulness of providing a form of institutional control of the waste disposed of, and the question of the length of time for such mechanisms, both of which are closely linked to the preceding point. A description follows of the R and D financing mechanisms in the field and of the surveillance systems to be set up. Finally, mention is made of the legal and practical difficulties encountered in the application of the third party liability and insurance regime to long-term waste management and the international dimension of all these questions. La presente communication aborde certains aspects, non-techniques, caracteristiques des problemes souleves par l'evacuation des dechets radioactifs. Il s'agit de la repartition des responsabilites operationnelles, reglementaires et administratives, de l'utilite de prevoir des moyens institutionnels de controle des dechets evacues et de la question de la longevite de tels dispositifs, etroitement lies au point precedent. Sont egalement examinees les mecanismes de financement des activites de recherche et de developpement dans ce domaine ainsi que les systemes de surveillance devant etre mis en place. Les difficultes juridiques et pratiques rencontrees dans l'application du regime de responsabilite civile et d'assurance a la gestion a long terme des dechets sont evoques, sans oublier la dimension internationale de ces questionsFiles
