'Independence' in question. The construction of a relative autonomy for nuclear organizations facing up to politics in France

This article examines the evolution of organizations under public control within the nuclear sector in France, from the establishment of the first structures overseeing nuclear operations to the adoption of the Nuclear Transparency law that created a formal agency (1973-2006). Drawing on archival research from the Ministry of Environment, as well as interviews, it focuses particularly on organizational reforms - whether implemented or abandoned - that were developed in response to the Chernobyl accident in 1986. The article demonstrates the extent to which these projects are based on divergent governance models and describes the differing interpretations of the concept of 'independence' of the regulator, illustrating how various actors understand the role of politics in nuclear decisions. The initial 'technopolitical' model was characterized by strong executive control over nuclear decisions and, during the period studied, it gradually gave way to a new governance model in which political actors become more distant from regulatory roles and nuclear organizations, both operators and regulators, become more autonomous. The article explores the conditions that were necessary for this relative autonomy to emerge and addresses the impact on public actors' capacity to control nuclear facilities and the executive's ability to challenge established governance arrangements. Cet article etudie l'evolution de l'organisation du controle public de la filiere nucleaire, de la creation des premieres structures supervisant l'exploitation des installations nucleaires jusqu'a l'adoption de la loi sur la transparence nucleaire creant une agence formelle (1973-2006). Fonde sur un travail d'archives du ministere de l'Environnement, ainsi que sur une enquete sur entretiens, il retrace, tout particulierement, les differents projets - realises ou abandonnes - de reforme organisationnelle du controle entrepris a la suite de l'accident de Tchernobyl en 1986. L'article montre a quel point ces projets reposent sur des modeles divergents de gouvernement du secteur et decrit les sens disparates de 'l'independance' du regulateur qui s'affrontent, lesquels constituent une entree heuristique dans les conceptions du role du politique dans les decisions nucleaires portees par divers acteurs. En partant d'un modele 'techno-politique' dote d'un fort controle de l'executif sur les decisions nucleaires, un nouveau modele de gouvernement se construit progressivement au cours de la periode, dans lequel les acteurs politiques sont mis davantage a distance des espaces de regulation du secteur, au profit d'une autonomie renforcee des organisations nucleaires (exploitantes et de controle). L'article interroge les conditions de possibilite de cette autonomie relative et aborde certains de ses effets, en particulier sur les modalites de controle des installations ainsi que sur la capacite de l'executif a remettre en cause les arrangements etablis autour de la regulation des activites nucleaires.
