The division of the court finally comes to the conclusion that - for the present partial license involved in litigation - in the light of the current knowledge in science and technology 'design-based' precautions to prevent risks as to the control of plant-internal incidents have been taken according to Para. 7, section 2, number 2 ATG a.F. In this case the court relies on the positive statements of the Rheinland Technical Inspectorate Association with regard to the design of the plant, as the court is convinced of the correctness of the facts taken as a basis and of the conclusions drawn from this. The plausible statements of the experts were not able to shake or to refute the arguments of the plaintiffs with regard to the 'conceptional' operation of safety systems in plant-internal incidents.
