This new edition invests more space than the previous one for consideration of industrial installations not subject to licensing, and of traffic-related emissions and their abatement. The commentary addresses a great number of questions arising from the interpretation of the Ordinance on Emission Control (BImSchV), the Noise Abatement Technical Code (TA Laerm), and the Clean Air Technical Code (TA Luft), as compared to the provisions of the Federal Emission Control Act (BImSchG). In addition, the administrative offences defined in connection with these provisions are discussed in great detail, and the crimes under the law are summarized in a survey. Last but not least, the commentary deals with all aspects introduced by EC law. The explanations refer primarily to the available body of jurisdiction in this field of law, presenting in-depth analyses of court decisions. The relevant literature of course plays an important part, too. The table of contents has been expanded as late as during the process of printing to include the latest developments such as the 1994 reform of the waste management law, and the novel Act on Free Access to Environmental Information (Umweltinformationsgesetz), and the amendments to the environmental criminal law that became effective in 1994. There is a new chapter considering the Ordinance on Emission Control Officers and Emergency Management Officers (5th BImSchV) effective since 1993. Enhancements have been made in the commentary text dealing with waste management plants and the provisions governing control of emissions from transport by road and rail. Further, the explanations referring to the environmental impact statement and the emergency management officer have been significantly enhanced.
