Bill project putting an end to the search for as well as exploitation of conventional and non-conventional hydrocarbons, and bearing various arrangements related to energy and to the environment (accelerated procedure) - Nr 155 + Impact study + Opinion of the State Council

After having briefly outlined that the bill project notably aims at a better protection of energy consumers, the different objectives and motivations are discussed. They concern the end of the search for and of the exploitation of hydrocarbons in the French soil in order to comply with the COP 21 Paris agreement and with the French Climate Plan. This results in an end to exploration and exploitation permits, and therefore the avoidance of local environmental impacts related to such activities (notably offshore). Some arrangements concern gas storages and consumers, and aim at a better safety of supply for the French gas system and consumers. Other arrangements concern relationships between providers and network managers, controls of of bio-fuels, and the reduction of emissions of some atmospheric pollutants. The text of the bill project is then provided as well as the report of an impact study which, for each of the mentioned issues (end of hydrocarbon exploration and exploitation in the case of overseas territories, gas storages and consumers, relationships between providers and managers, controls of bio-fuels) proposes a description of the situation and a diagnosis, a presentation of objectives, a discussion of the need for a new legal framework, an analysis of the impact of envisaged measures, a report of hearings, and modalities of application. A last text contains the opinion of the French State Council on the bill project, which, among other issues, notably addresses the following ones: guarantee of rights, ownership law, and right of free enterprise
