With its judgment from 30th March 1981 - 7 C 758/80 - the AG Gelsenkirchen has admitted the suit of a local public utility company against a Protestant parish for the payment of 10% of the electric power price (= DM 684.61) which had been kept back within the framework of a partial power price boycot, however, this decision was made under the assumption that the electric power supplied had not been generated in nuclear power plants. The application of the plaintiff, i.e. of stating that the defendant should be obliged to pay for electric power without reducing the price, was agreed upon with the following restriction: 'as far as the plaintiff shall provide such electric power for the defendant which does not come from nuclear power plants'. The indicated parish was allowed 'qualms of conscience' on account of its being supplied with 'nuclear electricity'. The plaintiff has filed an appeal against the judgment. (orig.)

Das AG Gelsenkirchen hat mit Urteil vom 30. Maerz 1981 - 7 C 758/80 - der Klage eines oertlichen Stromversorgungsunternehmens (Klaegerin) gegen eine evangelische Kirchengemeinde auf Zahlung der im Rahmen eines 'Stromzahlungsteilboykotts' einbehaltenen zehn Prozent (= DM 684,61) vom Strompreis stattgegeben, jedoch nur unter der Annahme, dass der gelieferte Strom nicht in KKW erzeugt worden sei. Dem Antrag der Klaegerin auf Feststellung, dass die Beklagte verpflichtet sei, kuenftig in Rechnung gestellte Strompreise ungekuerzt zu zahlen, wurde nur mit der Einschraenkung entsprochen: 'soweit die Klaegerin der Beklagten weiterhin Strom liefert, der nicht aus der Produktion von Atomkraftwerken stammt'. Gegenueber einer Belieferung mit 'Atomstrom' wurde der beklagten Kirchengemeinde 'Gewissensnot' zugebilligt. Die Klaegerin hat Berufung gegen das Urteil eingelegt. (orig.)Additional details
