Experience with the statutory licensing procedure; historical development and future structure
Description
Each licensing procedure has to define afresh the concrete measures to be taken to meet the general requirement of the German Atomic Energy Act that 'all necessary precautions as required according to the state of the art' have been taken to prevent damage. Events and incidents in nuclear power plants have not given cause for changes to the safety concept, merely resulting in some improvement in detail. Not only the consolidation of safety technology but also the evolution of juridical rulings and administrative regulations and decisions give us confidence that the Chernobyl accident will not have a negative impact on licensing requirements and licensing procedures; future recommendations should, as far as light water reactors are concerned, rather build upon experience with the Konvoi plants. Abstract (German)
Fuer die im deutschen Atomrecht in Form von unbestimmten Rechtsbegriffen enthaltenen grundsaetzlichen Zielvorgaben muessen in jedem Genehmigungsverfahren die konkreten Massnahmen definiert werden, mit denen 'die nach dem Stand von Wissenschaft und Technik erforderliche Vorsorge gegen Schaeden' erreicht wird. Vorkommnisse in Kernkraftwerken haben - abgesehen von Verbesserungen im Detail - keine Aenderungen am Sicherheitskonzept zur Folge gehabt. Nicht nur die sicherheitstechnische Konsolidierung, sondern auch ein weiterentwickeltes System aus rechtlichen Grundlagen und administrativen Vorgaben lassen erwarten, dass Tschernobyl nicht negativ auf die Genehmigungsverfahren durchschlagen wird; Empfehlungen zur zukuenftigen Gestaltung sollten daher im Fall von Leichtwasserreaktoren an die bei den Konvoi-Anlagen gemachten Erfahrungen anschliessen koennen.
