Environmentally hazardous installations near the border from the point of view of international law

Description
The accidents in the chemical plants at the Rhine river and the disaster of Chernobyl show that transnational regulations in the field of environmental protection have to be established. The admissibility of hazardous industrial installations near the border bases on principles of international neighbour law. In the opinion of the authors foreign borderers could have a claim to participate in the licensing procedure. (CW)
Abstract (German)
Die Unfaelle in den Chemiewerken am Rhein und die Katastrophe im Kernkraftwerk Tschernobyl zeigen, dass zwischenstaatliche Regelungen auf dem Gebiet des Umweltschutzes getroffen werden muessen. Die Zulaessigkeit umweltgefaehrdender Anlagen in Grenznaehe richtet sich nach den Grundsaetzen des voelkerrechtlichen Nachbarrechts. Nach Ansicht der Autoren koennen auslaendische Grenznachbarn einen Anspruch auf Beteiligung im Genehmigungsverfahren haben. (CW)Additional details
