Admissibility of action against a partial license granted for a nuclear power station

Guiding principles: 1. Any person who takes action to set aside an operating lincence granted for a nuclear power station according to Sect. 7 of the Atomic Energy Law on the ground of radioactive emissions connected with the normal operation of this station has to substantiate that the provisions of Sect. 45 of the First Ordinance on the Protection Against Radiation Hazards determining dose limits could be violated with regard to him, otherwise his action is inadmissible. 2. The rule to minimize irradiation of Sect. 28 of the First Ordinance on the Protection Against Radiation Hazards does not protect third parties. 3. A partial licence granted under the Atomic Energy Law cannot be fought with demurers to which the binding effect of an earlier granted partial licence is contradictory. (orig.)
