Description
Through the Environmental Framework Act in 1990, and then through the Unification Treaty, which entered into force on 03.10.1990, the former West German nuclear and radiation protection law became, with a few exceptions, the solely applicable law for the whole of unified Germany. The paper sketches those provisions of the Act and the Treaty that are essential to the judgement of the question of the continued validity of licences issued under the previous law of the former GDR. The final assessment is that the provisions geared to legal approximation in the field of nuclear and radiation protection law contained in the Environmental Framework Act and in the Unification Treaty are not perfect. All in all, however, they have proven their usefulness. (orig./HSCH)
Abstract (German)
Durch das Umweltrahmengesetz wurde 1990 und sodann durch den Einigungsvertrag mit Wirkung ab dem 3.10.1990 das bisherige bundesdeutsche Atom- und Strahlenschutzrecht, von einigen Ausnahmen abgesehen, das allein massgebliche Recht fuer das gesamte Deutschland. Das Referat skizziert die massgeblichen Regelungen des Umweltrahmengesetzes sowie des Einigungsvertrages, nach denen sich die Frage der Fortgeltung von nach frueherem DDR-Recht erteilten Genehmigungen beurteilt. Schlussbewertung ist, dass die Regelungen zur Rechtsvereinheitlichung im Bereich des Atom- und Strahlenschutzrechts im Umweltrahmengesetz und im Einigungsvertrag nicht vollkommen sind.
