AbstractAbstract
[en] The author explains that preliminary decisions and partial permits in atomic energy law are legal expressions of specific steps in the administrative procedure. In his opinion, it is difficult to assign rigidly a definitive partial regulation to the underlying element of a preliminary overall assessment which, in his view, established the binding effect of the respective step in the administrative procedure. The author also investigates the admissibility of collateral conditions and the binding action vis-a-vis the licensing authorities, the applicant and third parties. He pleads in favor of a revision of the licensing procedure by a site plan approval procedure. (HSCH)

Der Verfasser legt dar, dass Vorbescheid und Teilgenehmigung im Atomrecht gesetzliche Ausformungen des Teilverwaltungsakts seien. Die dogmatische Zuordnung der definitiven Teilregelung zum Rahmenelement der vorlaeufigen Gesamtprognose sei schwierig. Verbindende Klammer der stufenweisen Entscheidung sei auch die vorlaeufige Gesamtbeurteilung, sie fuehre zur Bindungswirkung des Teilverwaltungsakts. Der Verfasser untersucht ferner die Zulaessigkeit von Nebenbestimmungen und die Bindungswirkung gegenueber der Genehmigungsbehoerde, dem Antragsteller und Dritten. Er spricht sich fuer eine Reform des Genehmigungsverfahrens durch ein Standortsplanfeststellungsverfahren aus. (HSCH)Original Title

AbstractAbstract
[en] Two expert opinions designed for the 'Report on the fundamentals and practice of experts' activities within the framework of the licensing and control procedures and ordered by the Federal Government have been published. Mr. Lukes deals with expert affairs in the area of nuclear energy in the Federal Republic of Germany with special regard to the TUeV (Technical Supervisory Association) and to the Society for Reactor Safety. Theoretical models for a new organization are not feasible, partly because of legal reasons, partly because of practical reasons. Only a regulation related to expertise as well as objectivity and independence by means of regulations, and a change in the organizational by-laws of the experts' organizations seem to be useful. The second recommendation by Bischof and Pelzer deals with the legal situation existing in this area in France, the UK and in the USA. In the Federal Republic of Germany there are considerable discrepancies to be found, resulting from different constitutional structures and different forms of organizing the utilization of nuclear energy. The transferability of models from one legal system to another are therefore limited. (HSCH)

Veroeffentlichung zweier Gutachten fuer den Bericht ueber Grundlagen und Praxis der Sachverstaendigentaetigkeit im Rahmen atomrechtlicher Genehmigungs- und Aufsichtsverfahren der Bundesregierung. Lukes behandelt das Sachverstaendigenwesen im Kernenergiebereich in der Bundesrepublik mit besonderer Beruecksichtigung der Technischen Ueberwachungsvereine und der Gesellschaft fuer Reaktorsicherheit. Theoretische Modelle fuer eine Umgestaltung liessen sich teils aus rechtlichen, teils aus praktischen Gruenden nicht realisieren. Sinnvoll erscheine nur eine Regelung der Sachkunde sowie der Objektivitaet und Unabhaengigkeit durch Verordnung und Veraenderung der Organisationsstatuten bei den Sachverstaendigenorganisationen. Das zweite Gutachten von Bischof und Pelzer befasst sich mit der Rechtslage auf diesem Gebiet in Frankreich, Grossbritannien und USA. Es bestehen zur Bundesrepublik teilweise erhebliche Unterschiede, die sich aus den unterschiedlichen Verfassungstrukturen und Organisationsformen der Kernenergienutzung ergeben.
