[en] This subject plays at present in particular a role in the course of judicial examinations of immediately enforceable orders for the partial construction licences of nuclear power plants. The author distinguishes beween three kinds of forecast decisions: 1. Appraising forecast decisions with standards of judgment taken mainly from the fields of the art, culture, morality, religion are, according to the author, only legally verifyable to a limited extent. 2. With regard to forecast decisions not arguable, e.g. where the future behaviour of persons is concerned, the same should be applied basically. 3. In contrast to this, the following is applicable for programmatic, proceedingslike, or creative forecast decisions, in particular in economics: 'An administrative estimation privilege in a prognostic sense with the consequence that the court has to accept the forecast decision which lies within the forecast margins and which cannot be disproved, and that the court may not replace this forecast decision by its own probability judgment. In these cases, administration has the right to create its own forecast standards.' Judicial control in these cases was limited to certain substantive and procedural mistakes made by the administration in the course of forecast decision finding. (orig./HP)
[de]Das Thema spielt z.Z. besonders bei der gerichtlichen Ueberpruefung von Anordnungen der sofortigen Vollziehung von Teilerrichtungsgenehmigungen fuer Kernkraftwerke eine Rolle. Der Verfasser unterscheidet drei Arten von Prognoseentscheidungen: 1. Wertende Prognoseentscheidungen mit Beurteilungsmassstaeben vorwiegend aus Bereichen der Kunst, Kultur, Moral, Religion sind nach Auffassung des Verfassers nur beschraenkt gerichtlich ueberpruefbar. 2. Fuer unvertretbare Prognoseentscheidungen, z.B. ueber das zukuenftige Verhalten von Personen, solle grundsaetzlich Entsprechendes gelten. 3. Dagegen gelte fuer programmatische, prozesshafte oder gestaltende Prognoseentscheidungen, besonders auf dem Wirtschaftgebiet, ein 'administratives Einschaetzungsvorrecht in prognostischer Hinsicht mit der Folge, dass das Gericht die innerhalb des Prognosespielraums liegende und nicht zu widerlegende Prognoseentscheidung hinnehmen muss, ohne sie durch ein eigenes Wahrscheinlichkeitsurteil ersetzen zu duerfen. Der Verwaltung steht in diesen Faellen das Recht zur Bildung eigener Prognosemassstaebe zu.' Die gerichtliche Kontrolle beschraenkte sich in diesen Faellen auf bestimmte materielle und Verfahrensfehler der Verwaltung bei der Findung der Prognoseentscheidung. (orig./HP)
[en] This paper focuses on the uranium cartel - or marketing arrangement as its admitted participants styled it. The clash between US antitrust laws and cartels that fix prices is examined with particular emphasis on the uranium antitrust litigation and on a US antitrust lawsuit in which the courts rejected an attack on OPEC's price-fixing and output-limitation activities. Basic legal principles pertaining to this type of litigation are explained. Even more specialized defenses are available to complicate the litigation when foreign governments are involved with the cartel: sovereign immunity, act of state, and foreign governmental compulsion. It is concluded that antitrust litigation against a foreign cartel is not impossible, but it may be unwise in the long run if it precipitates an international reversion to protectionism. 35 references
[en] The higher administrative court at Lueneburg has rejected with costs - verdict of Sept. 13th, 1977 - VII OVG B 77/77 - the appeal of a nuclear energy opponent against the refusal of his challenging-of-a-judge-request, and thus against the fixing of an oral hearing in the court of a town situated within the bounds of the nuclear power plant in operation. [en] Systems that allow users to store and retrieve spatial data, provide for analyses of spatial data, and offer highly detailed display of spatial data are referred to as geographic information systems, or more typically, GIS. Since their initial usage in the 1960s, GISs have evolved as a means of assembling and analyzing diverse data pertaining to specific geographical areas, with spatial locations of the data serving as the organizational basis for the information systems. The structure of GISs is built around spatial identifiers and the methods used to encode data for storage and manipulation. This paper examines how GIS has been used in typical environmental assessment, its use for cumulative impact assessment, and explores litigation that occurred in the United States Federal court system where GIS was used in some aspect of cumulative effects. The paper also summarizes fifteen case studies that range from area wide transportation planning to wildlife and habitat impacts, and draws together a few lessons learned from this review of literature and litigation.
