[en] The introductory chapters of this book analyse the concept of fault as a basis for third party liability and the evolution of jurisprudence and doctrine towards the concept of absolute liability. The following part covers the Italian system of liability for hazardous activities. The nuclear third party liability system is then analysed according to existing international conventions and nuclear legislation in several countries. The Appendix contains various legislative and regulatory texts on nuclear third party liability in Italy and in other countries which provide for special legislation in this field. (NEA)

Le present ouvrage s'ouvre par des analyses introductives consacrees a la notion de faute comme base de la responsabilite civile et a l'evolution jurisprudentielle et doctrinale tendant a l'introduction du concept de responsabilite objective. La premiere partie est ensuite consacree a l'etude du regime italien de responsabilite du fait de l'exercice d'activites dangereuses tandis que la seconde partie est consacree au systeme de responsabilite civile nucleaire. [en] The special third party liability regime for nuclear damage is based on several international Conventions, in particular the 1960 Paris Convention and the 1963 Brussels Supplementary Convention, as well as on a number of directives adopted by the competent international organizations, namely NEA and IAEA. This regime is characterized by the absolute and exclusively liability of the nuclear operator, compensated by limitation in time and in amount, and by uniquity of jurisdiction. The French Act of 30 October 1968 is in conformity with these general principles. (N.E.A.)

[en] Publication of the Act on compensation for nuclear damage enabled the Danish Government to ratify the 1960 Paris Convention and the 1963 Brussels Supplementary Convention on nuclear third party liability which form the basis of this new text. Therefore, the Danish Act lays down an absolute and exclusive third party liability regime for the operators of land-based nuclear installations. The operators liability is limited to 75 million Danish kroner for each nuclear incident. However, if this amount should be insufficient to compensate all damage, the State has agreed to additional financial compensation up to 120 million European Monetary Agreement units of account. Claims for compensation brought by victims of a nuclear damage against the operator liable are statute-barred after a period of 10 years from the date of the incident, or three years from the date when the victim had knowledge of the damage. Furthermore, this Act prescribes that the nuclear operator must take out insurance corresponding to his amount of liability. (N.E.A.)

La promulgation de la Loi sur la reparation des dommages nucleaires a permis au Gouvernement danois de ratifier les Conventions de Paris (1960) et de Bruxelles (1963) sur la responsabilite civile nucleaire dont ce nouveau texte s'inspire tres etroitement. La Loi danoise institue par consequent un regime de responsabilite civile objective et exclusive pour les exploitants d'installations nucleaires terrestres. La responsabilite de l'exploitant nucleaire est limitee a 75 millions de couronnes danoises pour chaque accident nucleaire. Cependant, si ce montant s'avere insuffisant pour reparer tous les dommages, une intervention financiere est consentie par l'Etat a concurrence de 120 millions d'unites de Compte de l'Accord Monetaire Europeen. Les demandes en reparation exercees par les victimes d'un dommage nucleaire contre l'exploitant responsable sont prescrites au-dela d'un delai de dix ans a partir de la date de l'accident ou bien de trois ans a partir du jour ou la victime a eu connaissance du dommage. AbstractAbstract
[en] Nuclear terrorism is defined as an attack on a nuclear installation serving peaceful uses (such as a nuclear power plant) or non-peaceful uses. Radiological terrorism, which may be more likely, is defined as an action which doesn't trigger a nuclear reaction but gives rise to the release of radioactivity. The aim of this paper is to analyze the existing legal framework covering such situations. The relevant provisions of the Vienna and Paris Conventions on civil liability for nuclear damage, which represent a legal framework for nuclear liability at the international level, are discussed. The focus is on the identification of the the liable subject, including definition of the scope and nature of its liability. (author)

AbstractAbstract
[en] Civil liability for nuclear damage has been the subject of specific regulations by means of International Conventions and the laws of countries which may be qualified as suppliers of nuclear fuel, materials and installations. These regulations have been necessary to facilitate development of the peaceful uses of atomic energy. A second group of countries, namely those of Latin America, which are also purchasers, lack this specific legislation and have not ratified any International Convention on the subject. In those countries civil liability continues to be ruled by the classic norms of Roman Law. This difference in regimes has made for difficulties between suppliers and purchasers and could obstruct future exchanges in matters of nuclear energy between both groups of countries. It would be desirable for the competent authorities in purchasing countries to study the means of providing their countries with nuclear third party liability legislation based on the principles of the International Conventions. La responsabilite civile decoulant des dommages nucleaires a fait l'objet d'une reglementation speciale de la part de Conventions internationales et des legislations de pays que l'on peut ranger parmis les fournisseurs des combustibles, des matieres et des installations nucleaires. Cette reglementation etait necessaire pour faciliter le developpement des applications pacifiques de l'energie atomique. Un second groupe de pays, notamment ceux de l'Amerique Latine, qui appartiennent en revanche a la categorie des acheteurs, ne sont pas dotes de cette legislation speciale et n'ont ratifie aucune Convention Internationale dans ce domaine. Dans ces pays, la responsabilite civile est toujours regie par les normes du droit romain. Cette difference de regime a deja entraine des difficultes entre fournisseurs et acheteurs et pourrait etre a l'avenir un facteur susceptible de contrarier les echanges en matiere d'energie nucleaire entre les deux groupes de pays. [en] This article reviews the Chilean civil nuclear liability regime. The Nuclear Security Act (Law 18.302), enacted in 1984, and the Vienna Convention on Civil Liability for Nuclear Damage, ratified ed by Chile in 1989, are the fundamental laws of the current regime. Although Chile has no nuclear power plants, it is still important to analyze how the Chilean legislation would protect citizens from nuclear damages. This paper does not consider the policy reasons for and against the promotion of atomic energy. Rather, it critically examines the current status of the Chilean nuclear regime. Undoubtedly, if in the future Chile chooses to include nuclear sources in its energy mix, it will not be enough to introduce some isolated legal amendments, but it will be necessary to build a new Chilean Energy Regime which includes nuclear energy. In that scenario, though, it will be useful to know and understand how the current nuclear liability regime works. From this point of view, the reforms this article proposes to the current nuclear liability regime might be helpful to academics and policy makers alike
