[en] The first part of this paper is devoted to explaining in broad outline how insurance is provided for in various parts of the world. Explanations are given of such basic questions as financial capacity, insurers' retentions and reinsurance and how insurance markets handle exceptional risks, leading on to the question of the pooling of such risks. It concludes with a consideration of the practical possibilities for even small markets in new ''nuclear countries'' to develop their own nuclear insurance pooling arrangements. (NEA)

[en] Virtually any type of nuclear risk is insurable in principle, providing, of course, that the necessary standards of safety and control are met. Some of the risks are of a relatively minor character and no more hazardous than a simple conventional risk. But insurers would not consider as a minor risk anything which involves the use of nuclear fuel or other nuclear materials which are in a critical state or capable of releasing dangerous levels of radioactivity. These would include nuclear reactors or, indeed, any type of assembly which can not be regarded as subcritical. Most insurers would also regard installations involved in the manufacturing, processing and enriching of nuclear fuel, and certainly those concerned with the reprocessing of irradiated fuel and plutonium extraction, as major risks. Eigentlich ist im Prinzip jede Art von nuklearem Risiko versicherbar, natuerlich vorausgesetzt, dass die noetigen Mindest-Anforderungen an Sicherheit und Ueberwachung getroffen werden. Einige der Risiken sind verhaeltnismaessig harmlos und nicht gefaehrlicher als ein einfaches konventionelles Risiko. Aber die Versicherer wuerden nicht als geringes Risiko ansehen, was die Verwendung von Kernbrennstoff oder anderem Kernmaterial einschliesst, das in kritischem Zustand ist oder in gefaehrlichem Ausmass Radioaktivitaet freisetzen koennte. Hierzu wuerden Kernreaktoren gehoeren oder jede Anordnung, die nicht als unterkritisch angesehen werden kann. Die meisten Versicherer wuerden auch Anlagen zur Herstellung, Verarbeitung und Anreicherung von Kernbrennstoff, und sicherlich diejenigen zur Wiederaufarbeitung bestrahlten Brennstoffs und zur Plutonium-Extraktion als hohe Risiken ansehen. [en] Special conditions must be taken into account in transport insurance for nuclear materials even if the nuclear risk involved is negligible, as in shipments of unirradiated nuclear fuels. The shipwreck of the 'Mont Louis' has raised a number of open points which must be solved pragmatically within the framework of transport insurance. Some proposals are outlined in the article. AbstractAbstract
[en] According to the 1983 Act on Nuclear Third Party Liability the Federal Council must increase the minimum amount of three hundred million francs covered by private insurance when the insurance market offers a higher coverage at acceptable conditions. The Swiss insurers being in a position to cover the sum of four hundred million francs as from January 1986, the Government accordingly amended the Ordinance of 5th December 1983 on Nuclear Third Party Liability (ORCN). The Confederation continues to act as an insurer for the difference between this amount and one thousand million francs; contributions due in this respect will be reduced to take account of the greater sum to be covered by private insurance. The New Ordinance entered into force on 1st January 1986. (NEA)

Le Conseil federal est tenu par la Loi de 1983 sur la responsabilite civile en matiere nucleaire d'augmenter le montant minimal de 300 millions de francs couvert par une assurance privee, lorsque le marche de l'assurance offre une couverture plus elevee a des conditions acceptables. Les assureurs suisses etant en mesure de couvrir un montant de 400 millions de francs a partir du 1er janvier 1986, le Gouvernement a donc modifie en consequence l'Ordonnance du 5 Decembre 1983 sur la responsabilite civile en matiere nucleaire (ORCN). [en] The author analyses the papers presented at the Paris Conference on the maturity of nuclear energy. It is evident that financing possibilities will be a determinant factor in the rate of development of nuclear power during the years to come. After having evaluated the capital requirements necessitated for the development of nuclear programmes, the parties intervening have examined the means at the disposal of electricity manufacturers to meet these needs (self-financing, recourse to external financing, regrouping, on an international scale of the electricity manufacturers of the setting up of high capacity plants). As concerns the insurance problems, they are becoming more and more involved as nuclear applications, are further diversified and intensified. The parties intervening have discussed new tarification techniques likely to be applied and pointed out the possibilities offered by regrouping or pooling of insurers (Market Pool) which allow for a maximum of risks to be covered without exceeding the means proper to each company concerned

Les possibilites de financement constitueront a l'evidence un facteur determinant du taux de croissance de la puissance nucleaire dans les annees futures. Apres avoir evalue les besoins en capitaux necessites par le developpement des programmes nucleaires, les intervenants ont examine les moyens dont disposent les producteurs d'electricite pour y faire face (autofinancement; recours au financement exterieur; regroupement, a l'echelle internationale, des producteurs d'electricite pour la mise en oeuvre des installations de grande puissance). [en] The issue of compensation for nuclear damage was first taken up by Japan in the late 1950's as a result of the requirement by foreign nuclear suppliers that liability exemptions be placed in treaties and agreements. The Japanese Atomic Energy Commission established a committee to research foreign nuclear damage compensation systems. The recommendations of this committee formed the basis of Japan's 1961 Law on nuclear damage compensation. The committee's recommendations, the basic provisions of the 1961 Law and its later revisions are set forth in this paper. A brief description of the Japan Atomic Energy Insurance Pool also is provided. (NEA)

[en] This paper discusses the nuclear pooling system and co-operation between the pools, present practice and capacity, with a breakdown of the limits for third party liability and material damage. The author also describes the relationship between the pools and the nuclear operators (the policyholders), and concludes that the nuclear pools have been successful in serving the interests of their member companies, their policyholders and the governments as they have provided a stable insurance market by making available capacity in amounts that had never before been assembled and placed at risk in a single location. 2 tabs
