AbstractAbstract
[en] The Paris Convention and the Brussels Supplementary Convention have in substance remained unchanged since their adoption in 1960 and 1963, respectively. During that period, nuclear industry and technology have developed considerably while the financial and monetary bases of the Conventions have been shattered. The amounts of liability and compensation have been eroded by inflation, and the gold-based unit of account in which these amounts are expressed has lost its original meaning after the abolition of the official gold price. The question of revising the Conventions, in particular of raising those amounts and of replacing the unit of account, is therefore being studied by the Group of Governmental Experts on Third party Liability in the Field of Nuclear Energy of the OECD Nuclear Energy Agency. La Convention de Paris et la Convention Complementaire de Bruxelles sont demeurees inchangees en substance depuis leur adoption, en 1960 et 1963 respectivement. Au cours des annees qui ont suivi l'industrie et la technologie nucleaire se sont considerablement developpees, tandis que les fondements financiers et monetaires des Conventions ont ete bouleverses. Les montants de responsabilite et d'indemnisation ont subi l'erosion de l'inflation et l'unite de compte basee sur l'or dans laquelle ces montants sont exprimes a perdu sa signification primitive apres l'abolition du prix officiel de l'or. C'est la raison pour laquelle la question de la revision de ces Conventions, et en particulier de l'elevation des montants et du remplacement de l'unite de compte, est actuellement examinee par le Groupe d'experts gouvernementaux sur la responsabilite civile dans le domaine de l'energie nucleaire de l'Agence de l'OCDE pour l'Energie NucleairePrimary Subject
