AbstractAbstract
[en] The purpose of this project is to anticipate and address institutional problems that may arise from the adoption of NRC's proposed Policy Statement on Safety Goals for Nuclear Power Plants. The report emphasizes one particular category of institutional problems: the possible use of safety goals as a basis for legal challenges to NRC actions, and the resolution of such challenges by the courts. Three types of legal issues are identified and analyzed. These are, first, general legal issues such as access to the legal system, burden of proof, and standard of proof. Second is the particular formulation of goals. Involved here are such questions as sustainable rationale, definitions, avoided issues, vagueness of time and space details, and degree of conservatism. Implementation brings up the third set of issues which include interpretation and application, linkage to probabilistic risk assessment, consequences as compared to events, and the use of results
